Seven Generations Village, LLC requested a determination that the subject tract of land include 27 discrete parcels that were lawfully created at a time when land division approval under the regulations listed in Jackson County Land Development Ordinance Section 1.7.1 was not required.  The majority of the land was zoned EFU with smaller portions zoned WR and FR.  The scope of review is limited to the determination of lot legality – no land use permits were requested.  At such time as any lawful lot or parcel is proposed for use or development, the same will be subject at that time to any applicable regulations for the underlying zoning district and the county as a whole.

Based upon the foregoing findings of fact and conclusions of law, it was ultimately concluded that 1) the subject tract of land includes 27 discrete parcels that were lawfully established as discrete units of land prior to any regulation requiring land division approval by Jackson County or any other review authority and 2) the parcels do not require further division approval under Chapter 10 of the Jackson County Land Development Ordinance to be recognized as separate parcels.
